3. DESCRIPTION OF SERVICES
Free Services-General Use:
Pagecoop general use is free. The number of picture uploads per Group with the free version is limited to 200 pictures. A non-exhaustive list of services included for the general use (the free version) for all Pagecoop members is:
* to create an unlimited number of Group Pages or be invited to a Group Page
* to create a message within a Group Page called a “Post”. A Post can include a text, some pictures or a URL link to a video.
*to rate a Post posted by another group member with a grade from 1 to 5 stars.
* to write a comment in relation to a Post
* to enter and edit an event in the Group Calendar
* to edit their profile in every group independently at any time as well as to being able to set-up the privacy setting for the information displayed about their profile in each Group.
* to send Posts via emails
The Group Administrator also has extended powers. The Group Administrator is initially the person who created the Group Page. The Group Administrator powers are transferable to another Group Member or can also be shared with another Group Member.
The Group Administrator can:
* remove any member
* delete the Group
* Create and Edit the Folios (folios are customized pages where the Group Administrator can put more information)
Upgrade Version (paying version):
The Upgrade Version provides extended services. Any group member can decide to pay a monthly subscription fee to upgrade the Group Page. The subscription can be cancelled at any time but there is no refund for payment already made.
Upgrading the Group Page :
*increases the maximum number of pictures uploads from 200 to 2000 pictures.
*enables the file sharing feature which provides a 2GB space where the group members can share files by uploading and downloading them within the private space of the Group Page.
The maximum number of pictures uploads remains 2000 pictures after a first time payment even if the Upgrade Version subscription is cancelled afterwards.
The file sharing center is disabled the first day of the next month after the subscription is cancelled. All files in the file sharing center are irretrievably deleted when the file sharing center is disabled.
4. YOUR REGISTRATION OBLIGATIONS
5. BILLING AND SUBSCRIPTION (UPGRADE VERSION ONLY)
Pagecoop charges and collects in advance for use of the Upgrade Version of the Service. Once you have entered your credit card information with our payment gateway, Authorize.net, Pagecoop will automatically bill your credit card each month on the same day of the month as your initial payment, unless you cancel your subscription.
You agree to provide Pagecoop with complete and accurate billing and contact information. You agree to update this information within 30 days of any change to it. If the contact information you have provided is false or fraudulent, Pagecoop reserves the right to terminate your access to the Upgrade Version of the Service in addition to any other legal remedies.
If you believe your bill is incorrect, you must contact us in writing within 60 days of the invoice date of the invoice containing the amount in question to be eligible to receive an adjustment or credit.
Pagecoop reserves the right to change its prices and at any time. In the case that we decide to change our prices we will inform the customers/subscribers at least one month in advance.
6.1 NON PAYMENT TERMINATION
In addition to any other rights granted to Pagecoop herein, Pagecoop reserves the right to terminate access to the Upgrade Version of the Service if your Upgrade Version account becomes delinquent (falls into arrears). Delinquent invoices (accounts in arrears) are subject to interest of 1.0% per month on any outstanding balance, or the maximum permitted by law, whichever is less, plus all expenses of collection. If you or Pagecoop initiates termination of this Agreement, you will be obligated to pay the balance due on your account. You agree that Pagecoop may charge such unpaid fees to your credit card or otherwise bill you for such unpaid fees.
You agree and acknowledge that Pagecoop has no obligation to retain the files uploaded within the Upgrade Version (File Sharing) and that such files may be irretrievably deleted if your account is delinquent.
6.3 TERMINATION BY THE USER
If you wish to terminate your Pagecoop account, you can do so by deleting your account : (Go to “My account” and click on “Delete my Account”). Beware that deleting your account will mean that you will lose all the data and services attached to your account (Group Pages with their content, Upgrade Versions, Account information, etc).
When you delete your account we may save some or all of your personal data and information you uploaded or posted on Pagecoop for a maximum of 30 days –except for transaction record keeping for which the period may be longer. After 30 days all your data and information (which are not for transaction record keeping purpose) will be definitely deleted from our database.
7. MINIMUM AGE
Services are available only to individuals who are at least 13 years old. If you are under 13 years old, do not attempt to register or use the Services.
You can buy the upgrade version only if you are 18 years old or older. If you are under 18 years old, do not attempt to pay for the upgrade version.
8. USER CONDUCT
By way of example, and not as a limitation, you agree not to use the Services:
- to abuse, harass, threaten, impersonate or intimidate other Pagecoop users;
- to post or transmit any content that is unlawful, infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, threatening, abusive, harassing, tortuous, or defamatory, or content that contains homophobia, any other sexual discrimination, ethnic slurs or religious intolerance;
- to harm minors in any way
- to post or transmit any communication or solicitation designed or intended to obtain password, account, or private information from any Pagecoop user;
- to create or submit unwanted email (“Spam”) to any other Pagecoop users;
- to violate any laws in your jurisdiction (including but not limited to copyright laws);
- to make any automated use of the system
- to attempt to use the identity of another user or person;
- to sell or otherwise transfer your profile.
- to upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any website or computer or computer software or hardware or telecommunications equipment;
- to promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, without limitation, providing instructions on how to assemble bombs, grenades and other weapons or incendiary devices;
- to upload, post or otherwise transmit any content that is intended to take advantage of a user. Such content may include, but is not limited to, "get rich quick", "get paid to surf", pyramid/MLM, or other dubious schemes.
9. USER RESPONSIBILITIES
You are responsible for all information you upload on Pagecoop. Pagecoop cannot and will not be liable for any content posted by the users on Pagecoop (“User Content”).
By uploading, submitting or otherwise disclosing or distributing Content of any kind at or on the Site or otherwise through the Services, unless source quoted, you represent and warrant that you own all rights in the Content and you agree that the Content will be subject to the Creative Commons Public Domain License, available at http://creativecommons.org/publicdomain/zero/1.0/
Pagecoop does not pre-screen the content posted by the users. The users are responsible for the content they post online within Pagecoop. Pagecoop may from time to time monitor or review User Content posted on the Site and reserves the right to remove, without notice, any User Content that in Pagecoop's sole discretion violates the User Conduct rules set forth above. However, Pagecoop is under no affirmative obligation to monitor, review or remove any User Content, is under no affirmative obligation to take any action in response to any User Content, and assumes no responsibility or liability arising from the content of any such User Content, nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, threat or inaccuracy contained in any User Content that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Pagecoop will fully cooperate with any law enforcement authorities or court order requesting or directing Pagecoop to disclose the identity of anyone posting any such information or materials. Pagecoop reserves the right to deny in its sole discretion any user access to this Site or any portion thereof without notice.
If the Group Administrator has posted the inappropriate content then you can decide to first discuss the issue with him/her and ask him/her to remove the inappropriate content. You can also choose to leave the Group.

For serious abuses Pagecoop retains the right to alert the legal authorities and internet police if existing..
The Services may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Pagecoop has no control over such sites and resources, you acknowledge and agree that Pagecoop is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Pagecoop shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.
11. COPYRIGHT COMPLAINTS
Pagecoop respects the intellectual property of others. It is Pagecoop ‘s policy to respond expeditiously to claims of copyright and other intellectual property infringement. Pagecoop will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, Pagecoop may act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and may act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. Pagecoop will terminate access for subscribers and account holders who are repeat infringers.
Notifying Pagecoop of Copyright Infringement: To provide Pagecoop notice of an infringement, you must provide a written communication to the attention of “DMCA Infringement Notification Dept.” care of firstname.lastname@example.org that sets forth the information specified by the DMCA (http://www.copyright.gov/title17/92chap5.html#512 ). Please note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that an activity is infringing your copyright.
Providing Pagecoop with Counter-Notification: If we remove or disable access to content in response to an infringement notice, we will make reasonable attempts to contact the owner or administrator of the affected site or content. If you feel that your material does not constitute infringement, you may provide Pagecoop with a counter notification by written communication to the attention of “DMCA Counter Notification Dept.” at email@example.com that sets forth all of the necessary information required by the DMCA (http://www.copyright.gov/title17/92chap5.html#512 ). Please note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that an activity is not infringing the copyrights of others. If you are uncertain whether an activity constitutes infringement, we recommended seeking the advice of an attorney.
13. DISCLAIMER OF WARRANTIES
Your use of the Service and the Site is at your sole risk. The Service is provided on a ”As is” and “As available” basis. Pagecoop expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Pagecoop will make reasonable efforts to maintain the Service. However, Pagecoop is not responsible for any damage caused by the use of Pagecoop, due to data loss, unavailability of the service, bugs, breach or leakage of private information, hacking or any other cause.
Any material downloaded or otherwise obtained through the use of Pagecoop is done at your own risk and discretion and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
You acknowledge that Pagecoop has no control over, and no duty to take any action regarding: which users gain access to the Site; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release Pagecoop from all liability for you having acquired or not acquired Content through the Site. The Site may contain, or direct you to sites containing, information that some people may find offensive or inappropriate. Pagecoop makes no representations concerning any content contained in or accessed through the Site, and Pagecoop will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Site.
14. LIMITATION OF LIABILITY
Neither Pagecoop nor its partners will be liable for any loss of business, profits or goodwill, loss of use or data, interruption of business or for any indirect, special, incidental or consequential damages of any character, (however arising, including negligence) arising out of or in connection with or that result in any way from your use or inability to use the Services or the Site, or that result from errors, defects, omissions, delays in operation or transmission, or any other failure of performance of the Services or for any direct damages in excess of $50 in the aggregate.
Pagecoop is not responsible or liable for any content posted or uploaded by users.
15. PAGECOOP REFUND GUARANTEE
Because of the low subscription price and the relatively high transaction fees charged to us for each transaction we do not have a refund guarantee. All sales are final. You can of course cancel your Group Monthly Subscription at any time but there will be no refund for previous payments. However, if you believe there was a mistake or an error in the billing process please contact us at firstname.lastname@example.org and we will glad to assist you.
16. INTERNATIONAL USE
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
17. LINKS & MERCHANDISE
The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Pagecoop has no control over such sites and resources, you acknowledge and agree that Pagecoop is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources.
The Pagecoop and “P” icon used on the Site and other Pagecoop graphics, logos, designs, page headers, button icons, scripts, and service names are or in the process to be registered trademarks, trademarks or trade dress of Pagecoop in the U.S. and/or other countries. Pagecoop’s trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion
